Formation of Agreement
A contract is created when the client accepts our quotation — verbally, in writing, or by allowing work to commence.
- The quotation provided is valid for 30 days from the issue date. After this time prices may have to be revised.
- Any changes to the scope of work by either party must be agreed in writing by both parties and may affect the final price.
Scope of Work
We will provide services as detailed in the accepted quotation, carried out with care and skill in accordance with horticultural standards.
- Any drawing, plan, or image is provided for illustration only and cannot be used as a guarantee of exact results.
- Plants and materials may vary in size, shape, or appearance due to natural growth.
Payment Terms
We are not VAT-registered, therefore VAT is not charged on any goods or services.
- Payment is accepted by cash or bank transfer.
- Payment is due within 7 days of completion of work.
- Late payment may result in legal action and interest charges of 2% per month.
- Regular customers will receive 30 days’ notice of any price changes.
- A deposit is required for larger jobs. This deposit is non-refundable if the customer cancels with fewer than 48 hours’ notice before the start date.
Access & Customer Responsibilities
- The customer must ensure safe and clear access to the property during the agreed time, including the removal of furniture, toys, and pet waste, unless by prior agreement.
- The customer must inform us of any hazards, hidden obstacles, or specific requirements before work begins.
- The customer is responsible for securing any personal items, pets, or property on site.
- Any materials delivered or provided to the customer become the customer’s responsibility upon delivery.
Cancellations & Termination
Cancellation by the Customer:
- If the customer cancels giving more than 48 hours’ notice before work starts, we will refund any deposit (less costs already incurred).
- Cancellations within 48 hours of the start of work will result in forfeiture of the deposit, and you will be charged for work already completed.
- For regular services, you may terminate with 30 days’ written notice.
Cancellation by Mower Thyme:
- Mower Thyme may cancel or suspend work if you fail to pay, provide access, or breach these terms.
- Mower Thyme will not be liable for delays caused by bad weather, strikes, ill health, or other events beyond our control (force majeure). Work will be completed as close to the agreed time as possible, and customers will be kept informed.
Waste Removal
Mower Thyme can remove and dispose of green waste generated during work. This is an optional, separately quoted service based on the amount of waste to be disposed of — the choice is entirely the customer’s. Any additional waste removal costs will be clearly itemised and agreed in advance.
Warranty & Liability
Mower Thyme guarantees that all plants and materials supplied are of good quality and fit for purpose. We strive to deliver a high standard of work and service on every job.
- We offer a one-month warranty on plants. If a plant dies due to a fault in our planting or supply, we will replace it once. This does not cover damage from weather, animals, neglect, or improper care.
- Our total liability is limited to the cost of the services provided. We are not responsible for indirect or consequential losses.
- If supply issues affect costs, we will endeavour not to pass these on to customers. Notice will be given in the event of any changes.
- Nothing in these terms affects your statutory rights as a consumer.
Quality & Complaints
If you are unhappy with our work, please contact us within 7 days of completion — by phone, email, or in writing. We will investigate and work to resolve the issue promptly and to your satisfaction.
We actively seek feedback and follow up on completed jobs to ensure customers are pleased with the work and finish.
Data Protection
Mower Thyme will process and store your personal information only as necessary to provide our services, in accordance with applicable data protection laws. We will not share your details with third parties without your consent.
Changes to These Terms
- We reserve the right to update these terms and conditions at any time.
- The current version will always be displayed on our website, and customers can request a copy at any time.
Governing Law
These terms are governed by Scots law. Any disputes will be resolved through the relevant Scottish courts.
